What Are The DUI Laws In Connecticut?

In the state of Connecticut, it is prohibited to drive while “under the influence” of drugs or alcohol or with an “elevated” blood alcohol content (BAC). The maximum allowable BAC depends on the type of vehicle being operated and the age of the driver in question.

Individuals over the age of 21 may not exceed the BAC limit of .08% while driving. If a person is operating a commercial vehicle (such as a semi-truck), their BAC cannot exceed .04%. People under 21 are found to have an elevated BAC if it is found to be .02% or more.

Under state law, drivers consent to be tested for alcohol or drugs when they operate a motor vehicle. If the driver refuses to consent to an alcohol or drug test, the law imposes administrative license suspension as an alternative.

What Are The First Time DUI Penalties In Connecticut?

Criminal punishments for DUI include license suspensions, fines, and imprisonment. While first-time offenders have substantially lighter penalties, there are still factors to consider. Mitigating the legal challenges ahead of time will allow you to obtain the best outcome available.

In Connecticut, first-time DUI convictions may result in the following:

  • $500-$1,000 fines
  • Up to six months of imprisonment with a mandatory minimum of two days OR up to six months suspended with probation mandating 100 hours of community service;
  • 45 days of driver’s license suspension;
  • A one-year ignition interlock regulation upon driver’s license reinstatement;
  • Completion of a DMV-approved substance abuse therapy program prior to full driver’s license reinstatement;
  • Participation in a victim impact panel program; and
  • SR22 Insurance requirement.

The best way to understand the penalties you may be facing is by speaking directly to a first-offense DUI attorney about your situation. This will enable you to construct an effective legal plan to mitigate the repercussions of your case.
