Connecticut law defines DUI as “driving while under the influence of alcohol or drugs, or driving with an elevated blood alcohol content”. This means that for a non-commercial driver over the age of 21, the BAC limit is .08%. For commercial drivers, the limit is half that at .04%. For individuals under 21 suspected of driving under the influence, the BAC limit falls to just .02%.
Law enforcement uses tools such as breathalyzers and chemical tests to determine whether the individual in question is under the influence. If they are able to prove that their BAC is over the legal limit, it is likely that they will charge that person with DUI.
