What Are The Possible Consequences If I Am Found Guilty Of A DUI?

Since July 1, 2015 the following are the current penalties for DUI.

  1. For the first conviction of DWI/DUI/OUI, the offender will usually receive 45-day license suspension. If the suspension has already been served at the time of sentencing, then the offender may immediately collect their license, provided there are no other suspensions in place. The convicted must also install the Ignition Interlock Device and keep it installed for one year, once they have their license reinstated.
  2. For DWI second offense punishments, the offender will have their license suspended for 45 days. If the suspension has already been served, then the convicted person will have their license restored immediately. The convicted then must install the Ignition Interlock Device, and the device must remain in place for three years.
  3. On a third or subsequent conviction, the convicted person will have their license permanently revoked. After two years, the convicted will be able to petition for reconsideration of the revocation.
