Interviewer: What concerns do clients most often express after a DUI arrest?

Steve Tomeo: The possibility of a jail sentence is usually their foremost concern, but that fear rarely exists in isolation. Clients are also thinking about the consequences of being absent from their families, unable to work, and unable to meet the obligations on which others depend. What may appear to be a question about incarceration is often a much broader concern about preserving a family’s stability.

Many worry about the strain on their marriage, how their household would manage without their income, and whether they could continue to make mortgage payments and provide for their family. The uncertainty itself can be difficult. They are trying to understand not only what might happen in court, but also how their loved ones would cope with the practical and emotional consequences of a jail sentence.

Employment is another central concern, particularly for individuals who drive a car or truck for a living. They worry about whether their employer would permit time away to serve a sentence, whether their position would remain available, and whether insurance-related concerns associated with a DUI could jeopardize their continued employment.

I take those concerns seriously. Behind the question, “Will I go to jail?” is often another: “How will this affect the people who rely on me?” Those are deeply personal questions, and they deserve more than a discussion of penalties alone.

A meaningful conversation about a DUI charge requires candor, patience, and compassion. Clients need understandable information, an opportunity to ask difficult questions, and confidence that their concerns are being heard without judgment. The aim is to address the legal issues while recognizing that the person facing them is also trying to protect a livelihood, a home, and the well-being of a family.
